1) Acceptance of Terms

Welcome to Jack Stack Shipping (“we,” “us,” “our”). By accessing or using ship.jackstackbbq.com, including placing an order, creating an account, or using any feature of our site (collectively, the “Services”), you agree to these Terms of Service (the “Terms”). If you do not agree, please do not use the Services.

2) Eligibility & Account

3) Orders, Acceptance & Availability

All orders are offers to purchase products. We may accept or reject any order for any lawful reason, including product availability, errors in pricing or product information, or suspected fraud. If we cancel an order after your payment is processed, we will issue a refund to your original payment method.

4) Pricing, Taxes & Promotions

Prices are shown in U.S. Dollars unless noted otherwise and may change without notice. Sales tax and other applicable charges are added at checkout based on the shipping destination and current regulations. Promotions and discount codes may be subject to additional terms and may not be combined unless explicitly stated.

5) Payment

We (and our third-party payment processors) accept the payment methods shown at checkout. By submitting a payment, you represent that you are authorized to use the payment method and authorize us (or our processor) to charge the full order amount, including taxes, shipping, and any applicable fees.

6) Shipping, Risk of Loss & Title

Shipping options, timelines, and restrictions are described in our Shipping & Delivery policy. Title and risk of loss transfer to you upon our delivery of products to the carrier. Delivery dates are estimates and not guaranteed.

7) Perishable Products & Handling

Many of our items are perishable and require timely receipt and proper handling. Please follow the enclosed instructions and any heating/handling guidance. We are not responsible for spoilage resulting from incorrect addresses, missed deliveries, delays after a delivery attempt, improper storage, or failure to follow handling instructions.

If a product you ordered is unavailable, we may contact you with options or cancel and refund that portion of your order.

If you include gift messages or special instructions, you agree that such content will not be unlawful, infringing, defamatory, obscene, or otherwise inappropriate. We may refuse to transmit or print content that violates these Terms.

WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT DEFECTS WILL BE CORRECTED.

17) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL JACK STACK SHIPPING OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE IN THE 90 DAYS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Jack Stack Shipping and our affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.

19) Governing Law & Venue

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of state and federal courts located in Jackson County, Missouri for any disputes not subject to arbitration (if applicable).

20) Dispute Resolution (Arbitration & Class Action Waiver)

At our or your election, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, and not in a class or representative proceeding.

We may update the Services and these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes are posted constitutes acceptance.
